In fact, the protection is enshrined in the U.S. Constitution\u2019s Fifth Amendment. Often, it\u2019s easy to identify when a subsequent prosecution would constitute double jeopardy. For instance, if a defendant is found not guilty of a crime by a jury, another prosecutor is not permitted to try the defendant again for the same crime with a different jury.However, a recent Florida theft\u00a0<a href=\"https:\/\/edca.1dca.org\/DCADocs\/2015\/4399\/154399_DC05_07142017_084309_i.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a>\u00a0considered whether the prosecution of both carjacking and burglary of a conveyance is effectively trying a defendant for the same crime twice.<\/p>\n<p>Florida Statute section <a href=\"http:\/\/law.justia.com\/codes\/florida\/2005\/TitleXLVI\/ch0775.html\" target=\"_blank\" rel=\"noopener\">775.021(4)<\/a> provided the rules of construction that served as the basis for the court\u2019s double jeopardy analysis.
